As the author of your business profile, product descriptions, Trade Leads and other information submitted at Trade.com.au, you take full responsibility for its accuracy and truthfulness. As the author, you confirm your information contains nothing illegal, pornographic, offensive or copyright protected.

No Liability
Acknowledging that the use of the data contained in this Site are delivered to you by way of this Site requires judgment and analysis, the User warrants and represents to Trade.com.au that it has the necessary expertise and judgment to use the data.

Information available at Trade.com.au or distributed from is provided "as is" without warranty of any kind, either express or implied, including without limitation, as to the accuracy of or non-infringement of property rights in the content, whether or not Trade.com.au has been given notice of any such defect. The User assumes the entire risk as to the accuracy of and the use of this Site and any information that is linked to or associated with.

Trade.com.au, its directors, officers, employees, agents and suppliers are not liable in contract or otherwise for any direct, indirect, or consequential loss or damage of whatever nature sustained by a User or others directly or indirectly as a result of making use of this Site and the data or services in it.

In using this Site, Users expressly waive any and all claims that they may have against Trade.com.au, its directors, officers, employees, agents and suppliers arising out of such use, and agree to indemnify Trade.com.au its directors, officers, employees, agents and suppliers against all actions, proceedings, costs, claims, demands, liabilities and expenses whatsover incurred by Trade.com.au its directors, officers, employees, agents and suppliers as a result of a breach of these Terms and Conditions by a User.

Reference to any product, process, publication, or service of any third party by trade name, trademark, manufacturer advertisement or otherwise, does not constitute or imply the endorsement or recommendation of such by Trade.com.au

Copyright and Trademarks
Please assume that everything you see or read on this Site or delivered by way of this Site is copyrighted unless otherwise noted. The copyright on this site and the underlying files which implement the features of the pages are the property of Trade.com.au and its licensors unless otherwise stated.

The reproduction or use of part or all of the content of this Site in any way (including without limitation viewing, downloading, printing and saving) is prohibited. You may not distribute, broadcast, modify, transmit, reuse, re-post, or use in any form the content of this Site, or use the content to build other databases without our written permission of Trade.com.au.

You may link to this Site provided that you notify Trade.com.au in writing and agree to remove such link immediately upon request by Trade.com.au to do so. You may not link to this site in a way that results in this site being displayed in a frame on your site.

Confidential Information
User acknowledges that information contained in this Site may be proprietary and confidential to Trade.com.au and its users. User agrees that it will not disclose, indirectly or indirectly data to third parties other than as required to carry out the purposes of this agreement.

Acceptable Use
Users agree not to use the Site to violate any law, to misuse the information or property of others for your own purposes or otherwise and not to make postings which are threatening or defamatory or otherwise injurious to the safety, business or reputation of others.

Without limiting the generality of the foregoing, Users shall not:

· Create multiple accounts for the same business and/or division/branch, or maintain multiple accounts for different businesses. One individual/business is entitled to one account. Users found to have created multiple accounts will have those accounts deleted and may be banned from Trade.com.au

· Provide contact information - such as email address, website URL, phone number, etc. - in any location other than the contact information section. Contact information is NOT displayed to Listed Members. To view contact information and display contact information, members should upgrade their Membership.

· Disclose private communications without permission to parties other than the intended recipient, or disclose confidential information.

· Post or transmit any unlawful, threatening, abusive, libelous, defamatory, obscene, pornographic, or profane information of any kind, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offense, or otherwise violate any local, provincial, state, national or international law, including without limitation, export control laws and regulations.

· Post or transmit any information or software that the sender is aware contains a virus, worm, or other harmful component.

· Upload, post, publish, transmit, reproduce, or distribute in any way, information, software or other material which is protected by copyright or other proprietary right, without obtaining the permission of the copyright owner or right holder.

· Falsify user information provided to Trade.com.au or to other users of the Service in connection with the use of a Trade.com.au service.

· Account sharing, including without limitation, letting third parties use your account and password. Only 1 Trade account per person and/or company is permitted.

Trade.com.au considers the above practices to constitute abuse of the Terms of Use. Engaging in one or more of these practices may result in termination of the User's account or the account being banned.

Solicitation Restrictions
Pursuant to the limitations described under "Acceptable Use", for the benefit of its members, Trade.com.au has established limitations on the number of messages that Users can send within a given time period.

Termination
In the event of a breach of these Terms of Use, or for any reason whatsoever including inactivity, Trade.com.au may in its sole discretion terminate and/or ban a member, user or subscriber immediately without fault or penalty.

Refund Policy
Trade.com.au reserves its rights under Law to offer Refunds only in its sole discretion and to full paid members who put heir case in writing only.

Applicable Law
You agree that the laws of Queensland Australia apply to any issue that may arise with Trade.com.au regarding this Site and to settle such dispute in the courts of Australia.
